No Refund Policy: Users acknowledge and accept that all funds recharged into the in-app wallet through the Autospire Team or integrated payment gateway are non-refundable.
Ticket Cancellation: Users may cancel their ticket/s only prior to the ball draw. Once the ball draw is underway, cancellation of ticket requests will not be honored.
Recharge Protocol: Recharging funds to the in-app wallet must be done exclusively within the application. Any external payments or recharges will not be recognized, processed, and/or honored unless stated or instructed by the Autospire Team.
Draw Schedule: Raffle draws will begin only after at least 70% of slots are filled but it will still depend on the Autospire Team. No specific timeframe is guaranteed for completing slot quotas.
Unforeseen Delays: Draw schedules may be adjusted or postponed due to system maintenance, force majeure, or policy revisions. Users will be notified accordingly.
B. Prize Mechanics
Prize Condition: Car, items, and monetary prizes are awarded strictly on an “as is, where is” basis.
Delivery and Processing Fees: Delivery and processing fees of the winning prize will be shouldered by the Autospire Team. We will never in any manner ask for delivery or processing fees to the winners.
Car Ownership: Transfer of ownership shall be completed, and all related expenses shall be shouldered by the winning user.
- All necessary documents will be provided by Autospire, such as the original OR/CR, deed of absolute sale, and valid identifications.
- Transfer of ownership is a must.
- If the grand prize is a brand-new vehicle, the sales invoice and registration may be processed directly under the grand winner's name. Please note that processing may take several working days depending on the dealership and relevant agencies.
Vehicle Inspection: Users are welcome to inspect the available or onhand car prizes in person at our facility located in Angeles City, Pampanga.
Jackpot Re-Draw: In the event the drawn jackpot slot or number has no registered participant, a re-draw will be conducted exclusively for the jackpot prize only.
Grand Winner Photo and Video Release: By accepting the Grand Winner prize from Autospire, the winner agrees to have their photo and/or video taken by Autospire Team or its representatives. The winner consents to the use, publication, and display of their photo and video on any and all Autospire social media platforms, including but not limited to Facebook, Instagram, Twitter, and within the Autospire app. The winner acknowledges that these images and videos may be used for promotional, marketing, and advertising purposes without any further compensation or approval. The winner waives any rights to inspect or approve the finished product and releases Autospire from any claims related to the use of their likeness.
C. Account Registration and Eligibility
User Eligibility: Any user of legal age is eligible to register and participate in Autospire. In cases where the user is below the legal age, participation is allowed with the understanding that the user is accompanied and guided by his or her parent or guardian. Any awarded prize particularly car ownership via "Deed of Sale" will be named and/or transferred to the user's parent or legal guardian, based on the user's designated choice.
Accurate Information: Users are responsible for providing accurate and truthful information during registration. The use of false, misleading, or fraudulent details may lead to suspension or irrevocable account deletion.
Account Responsibility: Users are solely responsible for maintaining the confidentiality of their account credentials. Any activity that occurs under your account will be considered your responsibility.
D. Comments and Community Guidelines
Respectful Conduct: Users must engage respectfully when posting comments within the platform. Abusive, defamatory, hateful, or discriminatory remarks will not be tolerated and may result in content removal or account suspension with a minimum 24-hour comment restriction, which may accumulate with repeated violations.
Spam Prohibition: Posting repetitive, irrelevant, promotional, or automated content is strictly prohibited. Spam detection will result in comment deletion and may lead to user restrictions, or irrevocable account deletion.
Enforcement: Autospire reserves the right to moderate, remove, or report any comments deemed inappropriate without prior notice.
E. Wallet and Financial Transactions
Fund Transfer Restriction: Users acknowledge and agree that requests for fund transfers between accounts are strictly prohibited and will never be honored by the Autospire Team.
Security: Users are responsible for securing their account or wallet credentials and ensuring they do not share access.
Fraud Monitoring: Autospire reserves the right to investigate and report suspicious or potentially fraudulent activities.
Exploitation Consequences: If it is determined that a user has exploited or attempted to exploit the in-app wallet system, Autospire reserves the right to take legal action, which may include reporting the incident to the proper authorities and pursuing civil or criminal charges pursuant to the Cybercrime Prevention Act of 2012 (RA 10175).
F. User Conduct and Fair Play
Fair Use: Users agree not to misuse features or game mechanics in a way that gives an unfair advantage or undermines the platform's integrity.
Collusion: Any form of collusion between users to manipulate outcomes or winnings is strictly prohibited and may result in disqualification, account suspension, or legal consequences.
G. Prohibited Activities
Manipulation: Users must not attempt to manipulate, use bots, or exploit system vulnerabilities. If a system vulnerability is discovered, users are encouraged to report it. We will assess and provide appropriate compensation.
Illegal Use: The app must not be used for any unlawful purpose or to promote illegal activities.
H. Limitation of Liability
No Guarantees: Autospire provides the platform "as is" without any warranties or guarantees of uninterrupted service, accuracy, or performance.
Indirect Damages: We are not liable for any indirect, incidental, or consequential damages that may arise from your use of the app.
I. Data Privacy and Security
Data Handling: Personal data collected through the app is processed in accordance with our Privacy Policy.
User Responsibility: Users must not share their login credentials and are responsible for protecting their data.
Compliance: Autospire complies with the Data Privacy Act of 2012 (RA 10173). Your personal data will never be sold or shared without your consent unless required by law.
J. Termination of Services
Right to Terminate: Autospire reserves the right to terminate or suspend user accounts, features, or the platform itself at its discretion, especially in cases of violation, misuse, or legal obligations.
K. Amendments
Policy Changes: Autospire reserves the right to amend these Terms and Conditions at any time. Updates will be posted within the app or on our website.
Continued Use: Continued use of the app after changes constitutes acceptance of the revised terms.
L. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes shall be resolved in courts located in Angeles City, Pampanga.
